Wages and Overtime
Under the Fair Labor Standards Act (FLSA), the federal minimum wage is $7.25 per hour as of Jan. 2025. Employees are entitled to the higher of federal or state minimum wage. Non-exempt employees covered by FLSA receive overtime pay at 1.5 times their standard rate for hours over 40 per workweek.
Exempt vs. Non-Exempt Employees
Non-exempt employees receive minimum wage and overtime pay. Exempt employees, including executives and professionals, are not entitled to overtime. Exempt status is determined based on salary and job duties.
